People have been calling firearms regulation unconstitutional for well over a century. It's still here. ATF doesn't write laws, but the law that created the ATF does give them the power to write rules. That's what this is. It also gives them and other law enforcement agencies the power to enforce those rules, which they are sworn to do. Supreme Court is always an unknown, so we'll see how that goes when it happens.

I think the issue per your first part is not them "passing" a law but instead how they have decided that they will "interpret" the current law. Either way, unconstitutional and hopefully the SC tells the ATF to pound sand. Regardless, don't comply with unconstitutional BS.

They said it themselves if they arrest a drug dealer or a domestic violence call and if they have illegal set ups then they can just charge them for that as well because they werent already going to jail or anything.
