Rule of Law: the desecration of the rule of law and what this means for our democracy

A.V. Dicey posited that the rule of law, amongst other things, "excludes the idea of any exemption of officials or others from the duty of obedience to the law which governs other citizens".

In an era where this fundamental tenet seems to have become little more than a convenient catch-cry, join the Hon Stephen Charles AO QC and Professor Anne Twomey AO as they discuss the desecration of the rule of law and the risks it poses to our democracy.

“If you feel that we are secure in our legal system because nothing has gone too terribly wrong for quite a long time, turn to the Provost's' volume 'The Third Reich in Power' and read all the index references to law and lawyers and see what can happen in civilized countries when extremes take hold...including of the legal system...and you will not sleep as comfortably at night. It is truly a pretty horrifying tale.”
Professor Sir Geoffrey Nice QC (Lecture at Gresham College 4 May 2016).

So glad to see matter being taken up by proffesionals.thank you. Unfortuntely 50% of us are in crooked uncaring ministers area. Really hoping that the last months of blatant corruption will get rid of them at election time.surely though a citizen should be able to take some of these matters tocourt if they could afford it.we cant continue into third world corruption just because greed is accepted.

Australian governments have presided over the desecration of the rule of law for more than two decades. The breaches have been known to all subsequent cabinets. Yet the breaches have become more blatant, opposition has been ineffective and prosecution (yes, at least some of the breaches are criminal and yes penalties are prescribed) has been zero.
It is the prime function of the Attorney General to uphold the rule of law. Who can bring a writ of mandamus to require the Attorney General to perform her duty? (Her duty is clearly to have police investigations provide evidence for prosecutor action before the courts.)

Is there any hope given the actions of the current federal government though?
