Medical Malpractice Jury Trial in NY; What Questions Will Jury Need to Answer?

In every jury trial involving medical malpractice, at the end of the case the jury is told to begin deliberating and answer the questions posed to them by the court.

What type of questions are typically given to the jury?

The first question that must be answered is whether the doctor(s) that you have sued were careless or negligent.

We must show that you are more likely right than wrong that what you are claiming is true. If five out of the six jurors conclude that you have, then they are obligated to give you an answer in your favor.

Then, they must next answer whether that carelessness was a cause of your injury.

Legally, this is known as causation or proximate cause.
in other words, there must be a connection between the wrongdoing and your injury.

If there is no connecting bridge between the carelessness and the injuries you suffered then the jury is required to give a verdict in favor of the doctor or hospital staff.

If the jury has determined that the doctor or hospital was careless and that their carelessness was a cause of your injury, then the jury must determine how much money you are to receive as compensation for all the harms, losses and damages you incurred from the time of the event up until the time of trial and from the time of trial into the foreseeable future.
