Yeh, it is what justice is today in the modern western world. It's all reduced to mathematical probability. Here in NZ we have the same problem with our justice. The police build their case on who they think did it using an inductive process instead of deductive. The trouble is that the justice system is highly politicised. If the police are not having successful convictions, the government looks bad politically. They are willing to spent more money fighting retrials because the confidence invested in justice foundational institution of the public, means the legal-rational  authority of the state itself is at stake.
