बड़ी अजीब बात है पत्नी सालों बाद भी डीवी केस कर सकती है। कोई टाइम लिमिटेशन नहीं है। जबकि डीवी होते ही तुरंत डीवी से संबंधित प्रोसेस प्रारंभ हो जानी चाहिए थी। एक ओर डीवी जैसा संवेदनशील मामला दूसरी और विलम्ब पर कोई कारवाई नहीं।ऐसी विडम्बना सुनकर और देखकर आश्चर्य होता है और झूठे केसों के लिए पृष्ठभूमि बनाती है। जो घटना सालों पहले हुई हो उस पर सालों बाद सक्रिय होना न्यायिक व्यवस्था की कमी ही कहला सकती है।

Crpc 468(2)(c) limitation ki baat karta hai. Jab dv act sec 28 me clear karta hai ki ye act crpc se govern hota hai to puri crpc isme applicable hai. Advocate sahab ek example dekhiye ki recovery papplication crpc 125(3) k antargat lagti hai. Is par supreme court ka kya kehna hai? Ab ek baat or ki dv act me crpc sec 300 bhi applicable hai fir to. Crpc 300 k atargat patni 2 jagah se maintenance hi nahi le payegi. Sahi baat to ye hai ki ye aisa act hai jisko har koi apne hisab se kaam me le leta hai. Ye act to pass hi nahi ho sakta lagu kese jo gaya? Pwdv act constitution k against hai.

Sir i think this is a good judgement for husband side as well . BEACUSE the mother in law of the wife cab also file DV case against Daughter in law anytime they want. Correct me if i am wrong.
