How to Apply for Land Title from Tax Declaration | Buying Property with no Title (Tax Dec only)

In todays video I’ll sharing with you how to process title transfer properties that only have a tax declaration but no title.

There are 3 stages of ownership of property:
Ownership by land title
Ownership by tax declaration
Ownership by rights

Ownership by land title is the strongest form of ownership. A land title, also known as a certificate of title, is a document that verifies a person's or group's right to purchase and acquire property. A property title can also assist landowners and homebuyers in determining existing liens, usage rights, easements, natural resource rights, and other rights.

Ownership by tax declaration. Although tax declarations or realty tax payment of property are not conclusive evidence of ownership, nevertheless, they are good indication of possession in the concept of owner for no one in his right mind would be paying taxes for a property that is not in his actual or at least constructive possession.

Ownership by rights is very hard to prove since you don’t have a legal document such as a title or tax declaration providing conclusive evidence as proof of ownership. Thus it is very risky to buy property with only “rights” as proof of ownership. You could end up buying from someone who isn’t legally entitled to the property and it could result to a Double Sale or a case when the property is sold to 2 or more different persons.

Very detailed but confusing. Maybe you can provide a flow chart on how things are and enumerate who is paying what -- the buyer or the seller with a timeline in the back drop.

Are these the same requirements for a seller only with a tax dec trying to acquire a TCT? (Not seller tax dec - > buyer tct but seller tax dec - > seller tct)

Madam may I ask what is VDAS is this a Verified Deed of Absolute Sale?
Second once we applied for Titling in our name, Do we have to go again to official process and pay for another set of Fees (CGT, Doc's Stamps, Transfer Tax and Registration Fee)? Thanks

Can we apply for titling if our taxdec land 50 years is now claimed by the NCIP says that the land belongs to CADT?? Do we have a chance for titling?

Great video, I just recently bought a land with only tax declaration. So if I got it correctly after the name transfer I can apply for title by next year after paying the 1 year land tax.

Siguro kung ang may ari ng lupa nagkainteres sa lupa pinatituluhan ng ibang tao.. na hindi nila alam nakatago ung titulo ng lupa matagal na panahon.. kakasuhan dyan ung nagpatitle at processors.

Ang tax declaration are never be ownership in land. Nasa ibaba yan ng tax declaration nyo..

Walang din katotohanan ung squatting ng matagal tapos magkakaroon ng tax declaration sabay title..

Hi, may i ask some questio ?

What ifs the deceased father had an original title ( red with stamp) with a deed of sale ..
But as we verify to municipality the title was transferred and got pending to other names.
How come that we had an original but as we verify it was transfer to other name.?

Atty may lang ako itatanong, title ang aking residential land sa pangalan ko sa taong 2011.ngayon mayroon nag reklaro na sa kanila Yong lupa, at ang hawak lang nila tax declaration.at sa taon 2023 lang binayaran Yong tax sa municipyo.anong ang aking gagawin
