Thank you for asking me “What’s the difference between a Bench and a Jury Trial?”

All trials - Bench or Jury - result in a verdict once all of the evidence has been presented and the law has been applied to the facts of a given case.

That said, the main difference between a Bench and Jury Trial is who returns the verdict.

Bench Trials are decided by a lone Judge and Jury Trial’s are decided by either 6 or 12 members of your community, depending upon the type of case that’s being tried.

As Judges are trained in the law, and because there is no jury selection process, Bench Trials tend to occur significantly faster than Jury Trials.

Also, since Judges are trained in the law, Bench Trials offer much less opportunity for the lawyers to play games, paint pictures or pull fast ones... Judges are just not susceptible to the same “magic” that might impress civilian jurors who are not trained in the law.

In some cases you don’t have a choice between Bench or Jury (for example, if you are accused of a probation violation or if you are a juvenile who is accused of an act of delinquency then you are stuck with a Judge), but for those who can choose you should fully vet the decision with your lawyer before committing one way or the other.
