Sadly, even the Fox guys set it wrong. At no time did Comey say "she didn't commit a crime".  He just said "I don't recommend prosecution".

When I started practicing law, there was a judge I appeared in front of every day. He never allowed a court reporter in the room. In hindsight, I realized it was because he didn't want anyone looking over his shoulder at how he ran his court, and he did a LOT of dirty things, mostly showing bias in favor of certain lawyers. Without a court record, no one could expose him. When the FBI investigated HIM, they recorded my interview. That's the case with Comey. No recordings of the interview and no court reporter making a transcript. Did he even record the statements of Abedin, Pagliano, etc??
