Right to Travel PERFECTION!

The 1st thing you should know is that Traffic/Transportation Code is for drivers engaged in transporting goods or people for a fee ONLY. It does not apply to a private citizen traveling in their private conveyance.

This incident occurred in Angelton, TX just south of Houston. TX
Once the Texas Trooper stated I was under arrest and he continue to interrogate me, I asked for my Miranda warnings. By law, the government must give the warnings (Arizona v. Miranda). He was able to confirm my DL and insurance from my license plate. Perhaps I should take off my plate.

Signature is required as a promise to appear bond. The only other choice this Trooper had was to take me directly to a magistrate. Trooper did not follow the law and never provided me with an attorney.

This trooper should be on a training video for troopers in training on how to not escalate interactions with the public. I give the trooper credit for his patience and professionalism and continuing to see this citizen as a human being and while I know he thought the guy was weird with his views, the trooper still was able to treat him with human dignity and respect. Good job.

Dear people: laws are not magical incantations wherin if you file the correct paperwork or use the correct words you are suddenly exempt.

Laws are statements of what the justice system is expected to enforce. The police, the judges, the lawyers, the politicians, and the overwhelming majority of the public interpret the law as stating you need a license, and that is how it is enforced. Your arguments are just time wasters.

This guy didn't win, the cop just wasn't in the mood to arrest him. If he fails to appear before that judge, he will go to prison.

Gotta say, that officer handled that really great!! He didn't let anything anger him or get under his skin with complete emotional control!! Wow. The officer was also very honest when he may not have had to be. Very impressive for both travelor and Peace Officer. Am so glad it had a safe out come. That's most important.

Really wasn't a Right To Travel incident. The officer checked his license via his computer. He verified that he has insurance. If those things were valid, all that was accomplished was annoying the officer. He has license plates. He has a valid license. He has insurance. Right To Travel is where the driver claims they require no plates, no insurance, no license or identification.

Getting an officer to read you your Miranda Rights is an excellent tactic. In doing so the operator now has no requirement to assist the officer in their investigation.

Look up 18 USC 31 definitions. Scroll to motor vehicle. Commercial. Period.

Person, last name, motor vehicle, resident, traffic, operator, carrier and transportation, these are legal terms. Travel involves none of them.
