Mobile Vehicle Audio Recording Systems (abbreviated MVARS) is the technical name for what is commonly known as a police dashcam. These are the video cameras that are mounted on the dashboard of cop cars and other vehicles that are used by law enforcement. Although not all police vehicles in California are equipped with MVARS, when a police vehicle that IS equipped with MVARS is involved in a criminal case, the suspect and their attorneys have the right to ask for and obtain the MVARS footage to help in their defense.

Obtaining MVARS is often the first step, and most important step, of defending a client who has been pulled over by a police officer. The MVARS footage will often show incidents of police misconduct that can get the charges reduced or dismissed in a criminal case.

Types of police misconduct that are commonly discovered by obtaining MVARS include:

1.) Police pulling over a vehicle without reasonable suspicion, or without witnessing a traffic violation.

2.) Police giving incorrect instructions for field sobriety tests during a DUI investigation.

3.) Police obtaining evidence in a criminal case through illegal means, after performing an unlawful search of a vehicle.

4.) Police using unwarranted and excessive force that causes physical harm to a suspect.

And 5.) Police failing to give Miranda warnings that inform a suspect of their legal rights, before interrogating an arrestee.

In addition to identifying police misconduct, the MVARS footage can also be used in other ways to help defend the client during their trial. For instance, the footage can be used during cross-examination of the arresting officer to contradict their testimony, or catch them lying about what happened before, during, and after the arrest.
