42nd Amendment of the Constitution of India (1976) made the advice binding.
The 44th Amendment (1978) however added that the President can send the advice back for reconsideration 1st. But if the CoM sends the same advice again to the President then he must accept it.

Indian primary law against corruption is Prevention of Corruption Act, 1988. The law is now in picture due to potential Centre Governor vis CM conflict prevalent within it.

**A. The**

⇒ Define Corruption
→ Draft the need of permission from authority
→ Provision of PCA, 1988
→ Define core public duty and public servant
⇒ Define procedure and required permission
⇒ Define punishment

The PCA, Act 1988 saw amendments in 2014 and became more inclusive. One of the important saw section is:

Art 17A: This defines no inquiry or enquiry or investigation can be done without the furnishing of a legitimate authority.

• Usually the appointment body is considered a legitimate authority.

• When the cases are put against political executive like CM or PM - the council of governor minister, governor or president is considered authority respectively.

• Usually the President or Governor gives sanction to prosecute cases.

Ex: Governor of Karnataka gave permission to investigate on the alleged corruption charge of MUDA against Karnataka Chief Minister.

• Supreme Court in multiple cases have held that under this Act it will the discretion of Governor or President and not bound to advise by Council of Ministers.

**Implications of SC Judgement:**

- Will make prosecution against big leaders possible.
- Necessary for the proper working of the law.
- Hold the leaders accountable.
- Provide a sense of duty and accountability to all public servants.

**Negative Implications:**

- May lead to Centre V/S state as usually government is seen as agent of central government.
- Lack of any framework or protocol to be followed while applying discretion.
- May lead to inloforure of working of democratically elected state government.

The law must be further amended to specify particular framework to be followed by authority while exercising out discretion and SC must also ensure that the law remain a law against corruption and not a political tool.

Article 74(1) provides that there shall be a Council of Ministers with the Prime Minister to aid and advise the President and such advice given by the Council of Ministers will be binding on the President after reconsideration and shall not be questioned in any court of law.
Similarly Article 164 states, "There shall be a Council of Ministers with the Chief Minister at the head to aid and advise the Governor in the exercise of his functions, except in so far as he is by or under this Constitution required to exercise his functions or any of them in his discretion".
Forty-second Amendment of the Constitution of India (1976) made it explicit that the President shall, “act in accordance with such advice”.
