Harvard was sued over discriminating based on race, to the disadvantage of Asians. This lawsuit was created and engineered with an eye to go to the Supreme Court. Today, we discuss the decision from the Court of Appeals, as a preview to an eventual episode of SCOTUS react :)

Hey, I am a 51 year old law student - 2L - and my prof is part of this case. He showed me the Amicus he wrote in support of the Asian students. This case is of interest to me as a and am loving your coverage.

Asian applicants: 0.08% compared to white students. But that wasn't the question posed. What was the difference compared to black students? That is the gap they need to examine.

IF 22% of applicants are asians, but those 22% are in the top 10% of applicants and they are not getting in while people in the lower 50% are, that seems like heavy descrimination

This case got very little coverage imo. I knew about it but it wasn't on any prominent or msm outlets. Not that I know of. Great coverage!

What's the breakdown of each race as a percentage of applicants who are then admitted? Also, comparing Asian-American applications only to white applicants as a way to say there was no discrimination is disingenuous to say the least. What was the actual application to admission ratio for White, Hispanic, African, Native, etc. If the ratios are higher for any group specifically then I would probably hazard a guess that shenanigans have occurred in attempting to achieve diversity.

So they fully evaded the issue by correlating Asian to White students... What is the percentage bonus or negative of being a Black applicant? If that is greater then oh +/- .1 % then there is a bloody issue and that was conveniently obfuscated! (and note .1% is a huge difference from how they adjudicate the racial "bonus" of Asian and White students) The whole premise of them only looking at the Asian Community vs the White Community is intrinsically racist as the are effectively setting being white as the default when for racial standing the default should be every race based on applications percentages for a given year aka every race evenly stacked against each other instead of setting a base line of white then comparing everyone to an arbitrary number.

How is it possible to assume that race profiling is a compelling interest other than by first assigning social characteristics to racial groups and then saying that it is important to have all those characteristics balanced in body of students?
I fail at wrapping my head around all this bullshit.

I always love when they call things "positive discrimination".... there is no such thing.... if someone is getting a plus based on "aspect of them they cant control" that gives them an advantage other dont have so u can always frame it as all the other are been discriminated against. and it don't matter if u discriminate against a majority or minority its bad regardless... if u cant replace the "race or other aspect with something else" and then it seems unfair its probably not a good thing been done... in fact saying that a race needs an advantage based on their race is racist in it self since it hints at them been lesser and need this to compeat at a equal level. keep the good vids comming. I look fwd to see where the supream court takes this. XD

Seems they cherry picked those statistics pretty well. I would assume you’d want to compare students where race was the major difference.
