The first two days in the courtroom have been full of information but some of the sections related to Nintendo's place in the market have been really weird to see unfold.

Nintendo switch is the Argument killer for Sony and the FTC. Thats why they don't want Switch to be in the conversation. They doing great without COD. Thats even with "weak hardware". Its hilarious 😂

It’s not a 1 to 1 comparison, but Microsoft can use the Wii as an example which was basically a souped up GameCube spec wise that competed against the 360 and PS3 which were much more powerful but destroyed them sales wise, similar to the Switch

The thing that baffles me is the FTC doesn’t understand the gaming market AT ALL! I get they’ll say anything that could get them the PI but they need to be factual. Excluding the Switch is not factual! It’s more nonsensical. If the Switch has a game Xbox and PlayStation has, if I already bought it on Switch, I’m not going to buy the same game on Xbox or PlayStation. You’d think with logic like that, FTC should consider Nintendo but here we are.

Lol Nintendo is def a competitor, if Zelda, last of us, and Star field released in the same month, I could see a lot of people choose Zelda over the others if they only had 70 bucks

The Judge has been asking some great questions so far.
Where the FTC lost the Nintendo argument is when the Judge asked the FTC why PC were not included as competition, with the FTC responding it's because they're at a higher price. Judge responded by saying you can do more on a PC than simply gaming, so can justify a higher price point. Also, they don't want to include PC because it's more expensive, while at the same time don't want to include Nintendo when the Switch and Series S are comparable in price 😳 ouch, no answer for that. Can't have it both ways.

This whole thing is the ultimate conclusion of the PlayStation Rebellion against Nintendo in the 1990s
The North American Crash of 1983 FOREVER SHIFTED the Capital of the Videogame Industry from its origin in the USA to Japan as Nintendo entered the American market with their Family Computer AKA Nintendo Entertainment System.
Nintendo wrote the Bible on how to run a Videogame Business & these rules STILL apply to this day.
The NES transformed the industry & put the Asian focus & culture in the Centerpiece of the Medium.
The Home Computer Market was upended by the NES & the NES sooner or later forced EVERYBODY to do business on the Videogame Console over the Personal Home Computer.
So everybody was either trying to outdo Nintendo in the paradigm they set (Sega, NEC, SNK) and/or was trying to rebel against the Nintendo World Order (certain elements of the PC market).
When Sony was snubbed by Nintendo (who was wary of expansionist Sony trying to own Nintendo), Sony joined the Rebellion.
But since Sony is not a natural gamemaker (their roots are in Audio/Video/Multimedia), they had to gather talent from the existing PC Rebellion & chose to run their Gaming business much like they ran their Music business.
Hence why the original name of Sony's gaming division was called Sony COMPUTER Entertainment.
But that COMPUTER part aroused the attention of the emergent King of Computers, Microsoft.



SCE went much further than Sega Does What Nintendon't & the former Nintendo PlayStation became the Anti-Nintendo.
If Nintendo was 1st Party focused, Sony would be 3rd Party focused.
If Nintendo traded on time-tested IPs & Mascots, Sony would trade on newly-turned IPs & NO Mascots.
If Nintendo the playing CARD company held true to CARD-TRIDGES, Sony the DISC company held true to COMPACT DISCS.
If Nintendo rooted itself on GAME part of VideoGAME, Sony rooted itself on the VIDEO part of VIDEOgame.
Whatever Nintendo was, Sony was determined to be the opposite.
And with CDs giving PlayStation a victory over Nintendo 64 & DVDs giving PlayStation 2 a victory over Gamecube, Sony falsely believed they dethroned & uprooted Nintendo as the Leader of the Industry. The gaming press believed this falsehood too.
Sony merely won battles in a war but they never truly won the war.
Pokémon & the Handheld Game Boy Console would always correct this mistake.
We saw the correction when Sony's PlayStation Portable got the wake-up call from Nintendo DS.
Nintendo corrected it ALL with the one-two punch of DS & Wii doing it THEIR way with lesser power to boot.

All the while in this fight between Sony & Nintendo, Microsoft saw Sony as an intruder on their COMPUTER turf.
Sony makes Hardware. A Computer is Hardware & if Sony ever locked down those PC developers, they could take a key component away from Microsoft's Computer Empire. Immediately Microsoft plotted the downfall of the Sony PlayStation.
The Manhattan Project would be the solution to all of this Japanese dominance.
That is the codename for both the Atomic Bomb & the DirectX program.
Microsoft was more specifically targeting Sony out of the Japanese contingent over Nintendo, Sega, & such.
And DirectX needed a body to house itself within so they created a DirectX Box or XBox for short.
The console color is radioactive green for a reason. It's the poison for the Sony's PlayStation & always has been.
Microsoft set Sony up for this current conclusion & possibly even worked with Nintendo to set these events in motion.
If Sony wants my American/European PC Developers, then they have to play a game of Tug-Of-War with me to get them.
2001's XBox reestablishes the American console in the business Americans created & builds its brand (XBox Live, Halo).
2005's XBox 360 aggressively attacks PlayStation 3 with its Xenon processor being a derivative of PS3's Cell processor (thanks IBM of the Sony-Toshiba-IBM Alliance) & forces PlayStation to lose its "Eastern"/"Western" balance in its library.

2013's XBox One "loses" the fight against Sony PlayStation 4 who absorbs the "Western" game scene XBox cultivated & fully loses the "Eastern" game scene which is further & further ruled by Nintendo.
2020's XBox Series gets Serious & fully unleashes the original plan now that Sony has lost its power in Japan.
Backed no longer by Microsoft's couch cushion money, XBox now has the full force of the Microsoft Corporation going ALL IN.
4 Console Generations playing possum & tug-of-war establishes the narratives they need to get past the regulators & close out Sony COMPUTER Entertainment for good. Sony can say Interactive all they want. Microsoft knows who they are.
The Crosshairs target Sony & it's a Direct Hit. DIRECT X. Putting PlayStation games on Windows PC means Microsoft wins.

As for Nintendo, they quietly undo everything Sony tried to accomplish in their PlayStation Rebellion.
Sony gradually builds their 1st Party presence as Nintendo makes their 1st Party Invincible & Transcendent in the industry.
Sony is seeking out All-Stars to represent the company as Nintendo SMASHES the industry with its time-tested IP & Mascots.
Sony is forced to go to CARD-TRIDGES (Vita) just like Nintendo was once forced to go to DISCS (Gamecube).
Sony tries to say they're "For The Players" while Nintendo continues to school everyone in the GAME of VideoGAMES.
It's so bad that the current Sony Group CEO wants a property like Mario after seeing the Super Mario Bros. Movie.
Nintendo of America is surrounded by Microsoft's offices in Redmond, Washington.
You really think this current outcome hasn't been planned 30 years back?
'Better Together' says Nintendo & Microsoft. 'Wii60' they used to say. Hahahahaha!
Sony's strengths have become their weaknesses. Microsoft goes to core of the PlayStation business: The 3rd Party.
Nintendo has transcended need of the 3rd Party after Sony pulled them away from Nintendo in the 1990s.
So why can't Sony do the same? And that's why FTC & CMA can't include the Leader of the Industry in the conversation.
Nintendo as always plays the long game like Hiroshi Yamauchi in a game of Go. Ask Bill Gates about it.
