Huge Ruling, and Not Much of it is Good. Washington Gun Law President, William Kirk, discusses the holdings of Bianchi v. Brown, the 4th Circuit's new judicial re-write of the Second Amendment. The mental gymnastics that these judges are willing to use is amazing. They are willing to intentionally lie about the historical rulings of the courts then invent new secondary tests that have never been applied just to make sure that they can reach a verdict that they want.
It might be to late to save the country.

I have a feeling the 2nd, 7th and 9th circuit courts are sending nasty grams to the 4th saying "what have you idiots done?".

And now to SCOTUS to remedy this issue. After all, they supposedly only refused to take the case to allow it to conclude.

They do realize that even the Congress that passed the NFA in 1934 RECOGNIZED that the MILITARY WEAPONS they were trying to restrict COULD NOT BE BANNED?

It's amazing how they all ignore the Miller case in their justification that Military arms aren't covered by the 2nd Amendment.

Having to live with this as a Maryland resident I am not at all surprised this ruling was made. SCOTUS is going to have to make the final decision at some point on appeal of this 4th Circuit decision. Semi-automatic AR type rifles are, beyond a reasonable doubt, clearly in common use.

"We hold that the the covered firearms are not withing the scope of the constitutional right to keep and bear arms for self-defense." I had to go back and reread the Second Amendment, just to be sure that I was remembering it correctly. Yep I was right, no where in there did it say anything about self-defense.

Finally one of these cases gets all the way through the lower courts. This must be appealed to the Supreme Court this next term. Hopefully they’ll take it up and restore our rights.
