You can't kidnap your own biological children. It is a natural and inalienable right for parents to have a relationship with their own child. It is a human right issue. The question will be, biblically, was the woman married when she had the children. Never mind what the court says (as natural and inalienable rights supersede court orders). This is guaranteed in the Declaration of Independence which was signed and dated by our government. If the woman was never married, the children belong to the woman. According to coverture law at common law, the man never had authority over the woman's body. If the woman was married, then divorced, the children belong 100% to the father. This is still how it is at common law (children are property of the father). The woman was never given permission to divorce her husband according to scripture. Therefore, unless the man divorced his wife for sexual immorality (Matt. 19:9) they are still considered married by God (any subsequent marriages after that would be considered adulterous Matt. 5:31-32). Therefore, a parent taking the children when they don't belong to them according to scripture (the meaning behind inalienable rights) could only be considered kidnapping if the man took children away from a biological mom whom he never married. Which looks to be the case here. That would mean, the woman had every right to take her biological children and run for the hills. The majority of other cases would be considered abandonment. Again, according to scripture.
