Which Scenario are you? Onshore, Offshore or Apart?

In this video our principal immigration lawyer, Martin Salvo, discusses the different scenario of the relationship of the partner visa applicants and sponsors whether they are Onshore, Offshore or Apart.

Key Topics Covered In This Video:

TIMESTAMP 1:20 - The most ideal scenario is where the couple is already here, living onshore and looking to apply for an onshore partner visa.

TIMESTAMP 3:58 - For offshore couples that are looking to come quickly, applying for a temporary visa and come onshore will suit you. Onshore applicants has more benefits as well.

TIMESTAMP 6:35 - For offshore applications, there's competing timelines. How long will the offshore partner visa take versus how long do you have left on the temporary visa that's been granted to you.

TIMESTAMP 7:27- The good news is currently, onshore and offshore partner visas can be processed relatively quickly compared to the last couple of years where you may have been waiting 12, 18, 24 months.

TIMESTAMP 9:29 - We ensure that whatever we do, we are reducing any possibility for couples to be separated.

TIMESTAMP 9:48 - For couples that are physically apart, you may find it more difficult to obtain and accumulate the types of documentation and evidence which are required to prove that you're in a de facto or spousal relationship.

TIMESTAMP 11:39 - The visa options that would work best for you would really depends on your scenario, whether or not you are onshore, both living offshore or currently living apart.

Hello Sir,
I just messaged you regarding my husband visa. He applied his 309 on 8 Feb 2020. My husband 309 visa has been granted on 30th January after 23months and 20 days. Our two years will finished tomorrow..We didn’t receive any email from the department regarding 100 visa. So I am confused he has to apply for 100 visa or not. Thankyou

Hi Martin I am wondering if my fiancé applied for a tourist visa to come to Australia do we put on the application that we intend to apply for a 820 when she arrives or should we not mention it ?

Hi Martin, great video. We are about to apply for a PMV300 ; as they've relaxed things a bit, was also looking at applying for a tourist Visa for her to come to Australia (from Kenya might be hard Im not sure) but if they do grant a tourist visa and she is able to get here, and after we've applied for the PMV300, could we then convert the offshore 300 to an onshore 820? Is that possible?

Hi Martin, really appreciate the time and effort you put into these videos they helped me alot! I (sponsor) applied for the 309 visa for my wife July 2021. We are currently both living overseas. December 1st 2021, we received an ROI for medical, police check etc which we got done. In the RFI email it says there is 28 days to submit it all. I submitted it all but didnt realise i had to 'click' the submit documents button. Until i saw it on Jan 3, since i was 4-5 days late did i get sent back to the queue? i havent heard anything since! Is it a good idea to reply the case office since i have her name / email? thank you!

Hey Martin! Thank you for the great video! My bf (from Canada) and I (an Australian citizen) are planning to migrate to Australia in May as I’ve been living with him in Canada for almost three years. If he happened to apply for the working holiday visa, would it be considered valid if we applied for an onshore partner visa during his stay? We’re trying to figure out if a tourist visa or the working holiday visa would work better. Thank you again. :)

Hey Martin, your videos are insightful! Thank you.
If an offshore partners visa is granted while in Australia on a family sponsored tourist visa (with no further stay clause) do I need to go offshore to make the partner visa valid or does the partners visa automatically supersede the tourist visa with 8503.
I look forward to your response. Thank you.
