Ranjan Gogoi: Basic structure of the Constitution has a very debatable jurisprudential basis

Former Chief Justice of India (CJI) and Rajya Sabha MP, Ranjan Gogoi, expressed his views during the debate on the Government of National Capital Territory of Delhi (Amendment) Bill, 2023, stating that the "basic structure of the Constitution has a debatable jurisprudential basis." The former chief justice of India said, “There is a book by Andhyarujina, the former solicitor general, on the Kesavananda Bharati case.” “Having read the book, my view is that the doctrine of the basic structure of the Constitution has a very debatable jurisprudential basis. I would not say anything more than this.”

The former Chief Justice of India is saying sir in the most peculiar way. He does not seem to have to stature of Chief Justice. He is quoting a book over Court judgement. The way he has been put to out-speak on issue is showing how people in the top echelons of institutions can be subverted.

The general public remarks as seen in the comments are also very debatable. As most of them hardly have any idea or indepth knowledge of law and also on whats the exact case and facts of matter.
He didnt become CJI out of BJPs blessings, but because of merit. So, there should be some level of respect and not go to conclusions without knowing facts and only following media channels who themselves are very biased and inclined.

We should know that its easy to blame and criticize a person when we oursleves have not taken any such responsible job in our lives to serve the pain and criticism that comes with it.
We should be more civilized and be factful or be aware enough before making remarks on a such a personality as the CJI.
