You did forget something... regardless of how stupid the "you got Disney Plus so we don't have to worry about killing you" claim is... sadly, Disney will probably get away with it since the restaurant in the park was not owned by Disney. Rather, they were just given Disney's permission to be inside the park... meaning that Disney might get off Scott free (though that restaurant will definitely not)

Edit: Should clarify! I'm not an expert on law (as several commenter's have pointed out) so I could be very wrong... and boy it would be very nice if I was!

Edit 2: Thank goodness they went back on that ridiculous claim! I do hope the family involved gets their proper justice... and that Disney will at least do something to make sure this doesn't happen in the future...

for those who dont understand, some companies put lines in their terms of service saying that you give up your legal rights to a lawsuit by signing up for a program. while smart, it can still fail if it isnt emphasized strongly enough
