The provisions relating to divorce in India are governed by the various personal laws and dissolving the marriage which is not working for either of the spouses is by mutual consent. The basic difference between mutual consent divorce and contested divorce is that in mutual consent divorce, both the partners file a joint divorce petition whereas in contested divorce, a one-sided divorce petition is filed by one spouse against the other in the court. In 2019, 7,727 divorce petitions were filed before the family court. Between 2011 and 2019, the numbers fluctuated between 7,500 and 8,300. There are numerous benefits which can be obtained by Mutual Consent Divorce, which are:
1. Removes unnecessary disputes thereby saving plenty of time as well as money for both the spouses.
