The BIGGEST Legal Trap For Gun Owners EVER?!

The majority of the states in the United States now allow constitutional/permit-less carry. The majority of people in those states who do carry will probably commit a felony today and never even know it.

What are we talking about?

The 5 years in prison felony charge that you likely commit multiple times per day without even knowing it.

Specifically: the gun free school zone (GFSZ). This is the law that criminalizes the possession of many weapons within 1,000 feet of a school.

18usc 922(q)(2)
(A)It shall be unlawful for any individual knowingly to possess a firearm that has moved in or that otherwise affects interstate or foreign commerce at a place that the individual knows, or has reasonable cause to believe, is a school zone.(iii)that is—

OK if firearm is:
(I)not loaded; and
(II)in a locked container, or a locked firearms rack that is on a motor vehicle;

"school zone" should be immediately around the school. i.e. the immediate perimeter around the school. NOT a huge swath of land around the school.

My home is within 1000 ft.
The government is unlawfully and unconstitutionally controlling my property use without compensation.

This was THE biggest turn off for me when this constitutional carry law came out. I also knew even before reading about it that there would inevitably be some obtuse wording in the massive law, to ensure that the regime can always get someone on something. It's how most laws are these days. I wish laws would return to plain language and not require a law degree and days of time, to read and understand. My international business law courses killed me. I found I had a head for it but ti was so convoluted and everything could be looked at in different ways to come to different (desired?) outcomes. It's the sickness of today.

We must make laws to keep law abiding citizens safe from false imprisonment 😢

Just goes to show how absurd our laws have gotten that so many people can unknowingly commit a felony.

I live directly across the street from a school. Obvious I qualify for the private property exception, but how can I leave my house armed? The moment I exit my property in any direction, I'm in the school zone.

Former client here. Why can't anybody use USC 18 Sec 241, 242 to go after government officials for these unconstitutional gun control laws? Put the Govs, legislators and judges in jail!

So weird how one can be convicted for something that Shall Not Be Infringed.

My father went to elementary and high school in the 1930's. He often told me stories about how he and other farm kids would take their .22 rifles with them to school, put them in the coat closet with their coats, and retrieve them after school so they could hunt on the way home. What small game they brought home was part of the family's dinner. I would speculate that this behavior was common throughout the early history of our country. That should constitute an historical president against gun free school zones if not the school carve-out.

Absolutely insane how this has come to be.

I started teaching high school in the early 90's. Students would bring me out to the parking lot to show me their guns that they had on their pickup truck gun racks. And of course the guns weren't allowed in the school itself. No one thought anything of it.

The world has really gone to hell. I graduated in 1983 and had a gun in my truck all the time, weather a deer rifle or a shot gun. Glad I grew up when we had rights. Just so sad to see everything go to hell in a hand basket.

Sounds very much like another area schools NEED to have their authority clipped. For too long “educators “ have infringed severely on both parents and students rights. More law suits are needed to trim government over reach.

When I was in the 8th grade in what was called junior high school a gun club was sponsored during lunch hour. Students brought guns to school to share them with other students..

In the city I retired from there was a high school surrounded by a bad neighborhood. A man on foot tried to do business with a local recreational pharmaceutical salesman about three houses down from the front of the school. It turned into a forcible reallocation of the gentleman's funds. He fled on foot into the school, the armed businessman followed. Police in the school intervened. We responded to an out of breath individual. Police asked him why he ran to the school. He stated that the businessman was going to kill him. He ran into the school not believing it would save his life, he ran in there hoping his assailant would follow. To jam up the young entrepreneur with federal as well as state charges. The danger of these zones being that others may flee into the schools seeking refuge, thereby exposing kids in the school to violence.

If this is the case, then ALL school zone should be clearly marked as "you are entering a gun free school zone" as well as "your are leaving a

What I personally like to see from you is about 90% things that have actually happened (i.e. settled law, analysis of rulings, interviews with individuals) and 10% speculation as to what the law could lead to in the future. Just my two cents. Love the channel!

Would love a further video on gun free “zones” as seen through the terms of the bruin decision. Thanks for your continued excellent explanations on these 2A matters
