Social Security Overpayments [How to Fix]

If you've received a notice of overpayment from the Social Security Administration, there are some specific steps that you need to take today.

For those who depend on Social Security payments, receiving a Notice of Overpayment is no fun. These notification letters will often show up after a change in income or family status and generally allege that the Social Security Administration has paid you too much money. This leaves many shaken who count on this income to buy their groceries or some other necessity.
IF YOU’VE RECEIVED ONE OF THESE LETTERS, THERE is a process to follow. Unless otherwise stated, you have three options. ONE - Pay the overpayment within 30 days AND TWO Appeal their determination within 60 days AND THREE Request a waiver
The option you choose depends on your circumstances. Personally, I’ve seen too many bad calculations by the Social Security Administration to ever recommend just repaying the amount requested. In my opinion, an appeal should always be the first step.
The first part of the appeal is to forget about the 60 day window. You should file your appeal within 30 days. Why? For those requesting an appeal within 30 days, the overpayment will not have to be recovered until after the case is reviewed. If you wait the full 60 days, it’s likely the Social Security overpayment recovery process will have already started. This means that the Social Security benefit will be reduced, or worse, eliminated until the overpayment is collected.

You really need to do a video on what to do when social security starts deducting an overpayment from your check when you've already paid the overpayment IN FULL & the only reason they didn't receive it is because they take longer to process your payment than they do to start collecting it. That 60 days needs to be put on them not me!

Thanks. This video helped me to understand my situation. I was overpaid 17k in the last three years, now SSA wants to collect that money based on WEP.

There are a lot of strategies to make tongue-wetting profit that the average joes don't know. . Personally, the financial-market for me seems the only way forward with my long time horizon (accrued roughly $457k in gains since Mid 2021 ) but if you don’t have that fortune of time it’s a tough market out there almost nowhere feels safe!

My wife was drawing disability long before I met her. In last couple years she had a review that determine she was not disabled (even with supporting documentation), 7 years after being married, after multiple waivers sent in, countless paystubs from my job sent in ( on time), letters saying it's not our fault on overpayment..so how is it possible #1 our income tax is now being taken hostage in reçoup excess of $13, 000 overpayment at rate of 1000-2000 a year.
#2 How do they have the right to attack our income tax when we did our part?
#3 if our letter says it wasn't our fault, why take something that is riflely not thiers?
Very informative video. Thanks.

I have a disability. I work, but I was getting SSDI payments as supplemental income since I wasn't making enough to live on. One year, the company I work for decided to give me a bonus since I had been with them for 15 years. Unfortunately, this turned out to be the kiss of death, as the bonus put me over the SGA limit for that year. A YEAR AND A HALF later, the SSA declared that because I was over the limit, I was no longer disabled and owed them over $19, 000 for all the payments I had received during that time, even though I was still earning very little after I got that bonus. It's ridiculous. I haven't paid them yet, but I'm going to fight it if I can.

This system is broke. Just received an over payment letter. They claimed the over payment is from 21 years ago! Who has records from that far back? To bring a claim 21 years after the fact is just plain wrong. There should be a statute of limitations on this type of action.

been to local ss office many times in the past 9 years, after being discarded from my 35 year employer because I turned a certain age. the majority of ss employees are incompetent, or poorly trained. I should have saved when I was young, but I never thought I would be old.

I'm so confused, my sister received a letter of overpayment and now they're taking $300 off her check.... Iv goggled everything and it said you must prove that it wasn't your fault and that it'll affect your living what's crazy is at the bottom of the letter it literally says "The overpayment was not your fault in any Would that be case closed!? Proving it wasn't her fault!? Lol

What will they do if you don't pay it back even when you don't collect SSI or SSDI anymore?

I have the nightmare of nightmares story for SS. Years back I filed for disability and was approved. With the medicare I was able to get a doctor. I now take the meds I could not afford. When my case was up for revue I could walk so no longer disabled. I appealed, worn choice. It says payments may have to be paid back. I not in my wildest dreams ever thought they would take 4 years. Now they want some $43, 000.00 back. I don't have and never will. I guess they take our home and we go homeless. Maybe they can go after my life insurance.

I fought several years to get SSI because I was short work credits. I worked with my husband for several years and got no work credits for those years. I was awarded full SSI 3 years ago. Now they have decided my husband was actually making to much money so they lowered my payment to $300. Now they want over $15, 000 in overpayments too. Said they can pull $90 from my $300 they put me down to this month. So now I’m down to $200 a month, and can’t pay my bills. I’m sinking so hard! I have started appeals on them saying my husband makes to much money. But they still lowered my payment to $300. I have reached out to several lawyers and no one wants to help me. Starting on the waiver now. My husband doesn’t help me with bills or anything. I am lost, sick, and now extremely stressed out!

Don't believe what SSA claims you owe. The SSA offices that spew out those letters do not know the SSA their own rules, regulations or simple arithmetic. The SSA actually overpaid me, but by far less than they demanded I repay. In my 10-year ordeal I got multiple SSA demand letters (5++) telling me I owed amounts as high as $61, 000. Every subsequent letter demanded some lesser amount to correct calculations. After the THIRD hearing the administrative law judge ruled I'd been overpaid only $38, 211. She advised the SSA Payment Debt Center (who spews out these demand letters) that the $38, 211 did not include any credits for the US Treasury seized from my benefits for 25 months. Nevertheless, after the judge's $38, 211 ruling, the SSA sent me another demand to repay $99, 000, not the $38, 211 less benefits withheld. Ultimately, the SSA owed me by their seizure of more benefits than I owed. Untrained staff with zero common sense. Bottom Line – The SSA in all likelihood overstated what you owe by thou$and$.

Hey Devin, I found your video very helpful but my question involves my parent. I was put on my father's social security (SSI) as the payee. My father recently passed away but there was an overpayment on it. I received several letters from Social Security and didn't put too much thought into it since it was my father's and he passed away. I finally called Social Security and they told me that because I'm listed as the payee I am liable to repay it send to collection. I thought it was ludicrous but do want to do the right thing. Any advise?

I was laid off from my job at age 61.I couldn't find a job and took early retirement at 62. I would like to think that being a part time photographer, making $1200.00 a month and well under the Substantial Services limit of 15 hours per month would insulate me from any overpayment issues. Still, the system makes me nervous.

I just got one of those letters yesterday. They said since I made so much in 2023, I need to repay all of the payments from may-december. My question is, The money I made in 2023 was PRIOR to me applying for and receiving my ssa benefit. I thought it would not count since I made that money before I even applied for ssa? Am I wrong? Even on my 1099k form, it shows my income from may -december at $0.

What if someone like myself already did an overpayment back in 2021. And got a letter and a copy of the receipt that my new balance is $0.00. And you have not received the money from Ssi for over three years not one check deposited in your account and you got the bank statements to prove that you never receive money from the government and then you got a letter stating that you owe them $3000 for an overpayment for the money you never receive can I fight in court because I submitted 2 appeals and yet still no reply and I got another letter saying I still owe them, and instead they’re gonna start making a decision.
