IMO repairing the car after a crash should not count toward the cost cap, especially if the crash is caused by an other team. It's a lot of unpredictable expenses you can't really estimate when preparing a budget.

Yes, naturally the FIA did not make use of the most severe punishment possible. Afterall it was a minor breach, not a major one - not the biggest punishment for not the biggest infringement.

Also the period Hamilton is talking about ist the one where the Mercedes was clearly superior anyway.
