A bilateral agreement definitely seems to be better. Unilateral agreement explanation seems to state even if they just get started with their end of the agreement and don't finish it the agreement has been fulfilled.

I had a question regaurding these types of agreements when negotiating debt settlements. Example If I send a creditor an offer to settle my debt for 10% of the balance and I sent a check for that amount, if the creditor cashed the check would they be required to perform under the terms and conditions of my offer? (action as acceptance)

There's quite a bit of ambiguity on the second agreement. I personally would not agree to it. There's no fixed price.
