If the lead is available to test it is also available to ingest. The cups testing positive can and will leave lead in/on any surface it sits upon. It can and will leech lead onto your dish rag and it will absolutely be available to contaminate your hands.

I remember learning about the Franklin Expedition and how one of their downfalls was the improperly made canned goods that used lead sodder to seal the cans, the sodder leaked inside the cans contaminating the food.

If a team comes together to test the tumblers to ensure no lead has leaked into the inner cup it should be fine. However, i am neither a doctors nor a trained scientist that one is on them.
