Incorrect, it uses a strawman argument by presenting negative rights as positive rights.

But even if these were positive rights, the right to life is the most important right and thus takes precedence over all other rights.

Take your shelter example, say for example there were a storm, I would argue that there is a temporary humanitarian duty of care.
