My experience of driving sober and suspicion of driving impaired. I didn't come to a complete stop at a stop sign. Pulled over and provided the required documents. He asked me to get out of the pickup. I asked him is that a request or a lawful order. He ordered me to exit the vehicle. (I don't drink alcohol, don't take illicit drugs wouldn't even know how to get them. No OTCs or pain drugs, completely clean) I got out of the vehicle. I had just got done with a 4 mile run. He asked where I was coming from. I told him from the north. He asked where I was going. I told him to the south. Now he is getting pissed. He asked if there was someone to come and get my vehicle. I asked why. He said that I suspect that you are impaired. I asked him that why am I not already arrested? I requested a breathalyzer. Blew 0.00. He said "You must be on something else. If you arrest me I will submit to a BAC with a second sample to a laboratory of my choice. If it all comes back negative them what. He said that we will deal with it later. I asked who is the "We" He didn't answer. Would you take a field sobriety test. I asked why. He said to make sure that you are safe to drive. I do not consent. He said that I must be on something else then. I said to him that if anyone could speak as articulate as I am could possibly be impaired. He said that articulate speech does not rule out impairment. In that case sir, I request your business card or Identification and do not mute or edit your bodycam video of this encounter. I was on my way with no charges and even used my turn signal to come from parked to traffic.

If you are not impaired, always ask the question, Could someone that speaks as articulate as I could be impaired. As for a business card and a FOIA request, of the bodycam footage,

IN CALIFORNIA, IF YOU REFUSE A BREATH OR BLOOD TEST, YOU WILL LOSE YOUR LICENSE FOR AT LEAST A YEAR THRU THE DMV. EVEN IF YOU ARE UNDER THE LIMIT. YOU SHOULD BE TELLING THESE DRUNK DRIVERS THIS INFORMATION. IT’S VERY IMPORTANT. ALSO, NOWADAYS WITH EVERYONE SMOKING THIS SUPER STRONG WEED AND DRIVING ALONG WITH ALCOHOL IN THE SYSTEM, BLOOD IS ALWAYS TAKEN TO CHECK THE DRUG LEVEL AS WELL SO BREATH IS NOT AN OPTION.

By the time they get your blood you will be more removed in time from the traffic stop, which will be harder for the state to prove your BAC at the time you were stopped.

what if the blood content comes with negative across the board and the charges are withdrawn, can the driver get the refund of towing, impound charges, costs associated with the restoration of the driver's license and the taxi or public transportation charges incurred to get to work? who should get sued to recover these costs?

I don’t understand the point of the legal limit beyond if you’re over you’ll be charged with driving while intoxicated no matter what and if you’re under you’ll be charged with driving under the influence, because whatever you did while driving that got the cop’s attention, even if not as a result of the alcohol, like you failed to signal just because you’re naturally too lazy to lift the lever, they will claim was due to being influenced by a drink and arrest you anyway. I never heard of anyone who’s had a drink yet under the limit passing a field sobriety test and being released on the spot to continue driving. I believe even being stone cold sober nobody will pass a field sobriety test due to how a cop chooses to interpret it, so one sip of beer and they will say the reason for pulling you over was a result of the influence of the beer... or they will just say you failed the sobriety test.

First of all, the individual MUST be in exigency before implied consent can be declared. This means if I find you unconscious, in peril and incapable of fending for self, I have the authority to PRESUME you would, IF you could, give me consent to take measures that will either improve your condition or save your life. Law enforcement blood draws for alcohol/drugs does NEITHER of these things and is therefore ILLEGAL. Anything you do under implied consent MUST serve to benefit the person from which the blood was drawn and NOT in the interest of a 2nd or 3rd party and certainly not for the purposes of obtaining incriminating evidence. We have a RIGHT against self-incrimination and a RIGHT to be secure in our person (body) papers (information) and property (blood tissue). NEVER submit to questions and or testing conducted by law enforcement officers. Field sobriety tests are NOT conducted to prove your innocence but rather your guilt. The burden of proof falls to the officers and you are NOT obligated to assist them with their investigation of your guilt or innocence. Let your lawyer sort it out.

The road side test, I have declined but I know I will have to go to the station and have breath or blood test, the difference is I trust the properly calibrated equipment over the road side test. The total lack of training I have witnessed in road side testing staggers belief.

If the police falsely claimed that I was under the influence of drugs, I would make them get a subpoena to draw my blood. Don't the police have to prove probable cause for the judge to give them a subpoena?

A person will drive, on average 168 times under the influence, before they get pulled over for a physical defect on the vehicle. Lights out...no turn signal etc.

So I got pulled over and had some drinks maybe 3 hours before I got pulled over he took my blood cause I told him I take adderall so I got a dui he said he was charging me for being on drugs when I go to court are they gonna look for drugs and alcohol or just drugs someone please help me im on probation and have court next week

A blood test using a alcohol swab can give a false positive result, so it will be best to insist that a betadine swab be used.
This I learned from a Dr. of nursing, who worked part-time at a jail facility.
