The relevance of judicial assistants to the Judicial Commission

The judicial assistants institution and their working relationship with judges are improving. In the Indonesian context, amidst of various issues related to judiciary, the discourse on judicial assistants becomes interesting. Judicial assistants (especially if it is placed at all level of court) may help maintain the quality of judges’ decisions amidst the ratio imbalance between the number of judges and the case load, which potentially make judges have to pursue the target of case settlement, but without the proper depth of consideration in such decision. The discourse regarding the existence of judicial assistants can be seen by the Indonesian Judicial Commission (Komisi Yudisial) from the perspective of enhancing the support system for judges in examining and deciding cases.

Furthermore, in the context of the Supreme Court justice selection, judicial assistants assigned at the Supreme Court can be perceived by the Judicial Commission as an outlet for scouting the supreme court justice in the future, both career and non-career. Career judges who become seconded judges in the Supreme Court can be considered to have added value (especially those with maintained integrity) when they later participate in the selection of candidates for Supreme Court justice. The Judicial Commission can also focus on mapping potential Supreme Court justice candidates from among those who have served as seconded judges.

Even for legal academics, serving as judicial assistants at the Supreme Court (which is not yet possible at the moment) can be a strategic choice if the person concerned has aspirations to become Supreme Court justice from a non-career path. In terms of the court’s benefit, the existence of an academic element as judicial assistants which is widely known in European Union countries will enrich the theoretical basis of a court decision, and bring legal practice closer to academic discourse, and vice versa.
