I work at a surveying company, deal with this kind of thing all the time. If someone’s fence is encroaching onto someone’s property by this small of a margin, there really isn’t anything you can do about it. If it exceeds a certain amount, usually owner of the fence agrees to just forfeit ownership of the fence to the neighbors

I was on her side until she demanded he build a new fence. She as a property owner has every right to ask someone to remove their property off her land, however has zero right demanding what someone else does with theirs.
