There's a legal term for this. Wage theft. A call center I worked for tried this. I refused.

The old "Free work preparing for work" scam.

This behavior from employers, while common, is actually illegal. Walmart and Wells Fargo both had to pay big money for pulling this kind of BS.

OP: "Here's how it works. First I clock in, then I do the work."

When I worked in NHS I was told to arrive 10mins before start of shift to prepare for work.
I replied OK I'll stop working 10mins before end of shift to prepare for finishing.
Never became an issue again.

And when you get hurt before clocking in, they will fight your injury pay… nope.

Bed Bath & Beyond managers always expected us to clock out, and then come back up front for the evening ''huddle." That stopped as soon as I called HR.

Had a boss while working at DMV that expected me to give that 15 minutes for free bullsh*t! She actually made the mistake of writing me up....I then promptly called BS in our weekly meeting. Was told to leave the building then for 3 day suspension. Long story short...I ended up being compensated for 15 minutes, 5 days a week for 3 1/2 years. Vindication never felt so sweet!😂😂😂

There are about 260 work days, assuming 5 on/2 off and no vacations. That free 15 minutes of work amounts 65 hours. Thats a week and a half of pay you get stiffed.

If you require me to be on premises you are obligated to pay for that time

I had this EXACT situation 10 years ago, when the manager began arguing with me I held my hand up until they stopped, then presented my hand for a shake and as they shook it I thanked them for my time and I was sorry it didn't work out.

When I left the room they were still standing there with their hand out.

This strategy isn't just a red flag, it is a blatant warning of what is to come.

4 years ago the business got hit with a bunch of violations by their local labor board and was forced to close, nobody cried.

Call the Wage and Labor Board. Then call your lawyer.

Depends on your definition of preparing for work. If you mean getting a coffee and taking a crap yeah, do that on your own time. Opening the the tool box and setting up the tools that is working and needs to be paid.

Tip to employers : you can’t declare an employee “hourly” to stiff them on full time benefits and then treat them as salaried. Can’t have your cake and eat it too. 🤷‍♀️

If I work I get paid. I'll do work only after I clock in

One boss tried to tell me that and i immediately told him No, i don't work for free. Every time he even tried to insinuate that i would just say out loud "I don't work for Free!"

Dear management whether I show up for work early is up to me, not you. As long as I'm there on time buzz off.

My very first day at a previous job started out like this:
"I'm happy to be here. I'm just gonna go smoke a cigaratte real quick before I clock in."
"Can you take that trash out."
"I can as soon as I get clocked in."

I was never asked to do work off the clock ever again.

I live in L.A., so traffic is nuts. I always leave early. Of course, sometimes that means you arrive early. At one job, I’d sit in my car and listen to the radio in the parking lot before my shift started. The owner had a fit and said I had to be in the office not sitting in my car in the work parking lot. I shouldn’t be coming into work only in time to sit down and start working, since I was already early. So, I started parking in the lot across the street and driving over to arrive at work at just the right time. Bosses are really weird.
