I went for police station and gave my petition but SI has took opposite party petition and informed me that he will file FIR on me taking their petition into consideration. Also when we went for SP for justice, SI abused and took an apology letter from us . He was saying to settle the matter out side as the case was about 420 sec. Till now no notice of 41a received . Just SI is contacting on phone and calling when he needed for PS and asking the information. He is also taking me to the MLA and making things discussed before MLA.

He is saying that he arrested us to everyone but still no FIR made and no information given

YES. 41 A notices links with FIR registry with a statement by the complainant by phone or by physical appearance. 1st stage is FIR. 2nd stage is 41a notices. 3rd stage is waiting for court orders to arrest to quash the FIR/complaint. if court orders are pending or under trial then, police officers must await.

ILLEGAL ACTIVITY 1: if FIR is self not registered and dealign case in the police station and settling or punishing or physically begin with remanding etc OR it is illegal

ILLEGAL ACTIVITY 2: even after FIR is registered, then pieces of evidence must be verified and investigated physically, technically to produce in court with prime of offense evidence with direct witnesses or by any online messages or phone calls. IF NOT. it is illigal.

ILLEGAL ACTIVITY 3: Even if the police do have evidence and registered, then must be intimated to the accused within two weeks with a notice stating that they do have a complaint and registered FIR with pieces of evidence/witnesses.

The accused or guilty must appear in the police station or surrender themselves in the court with legal proceedings.

police should not treat police stations as houses of court. it is very important to note. every police officer must know this.

police are for protection and security. NOT for punishment until the court orders are officially given, if essential.

నాకు 26 .06.2020 నాడు నాకు టైఫాయిడ్ జ్వరం ఉన్న నన్ను స్టేషన్ కు పిలుచుకొని 41 crpc ఇవ్వకుండా నన్ను కొట్టారు సార్.తర్వాత నేను హైకోర్టు కు వెళితే అప్పుడు పిలిచి 3రోజులు స్టేషన్ చుట్టూ నా భార్య పిల్లలను తిప్పుకొని 17. 7.2020 సాయంత్రం రాత్రి 7గంటలకు ఇచ్చారు

సార్ నమస్కారం happy new year అండి.41a కేసు గురించి నోటీసు ఇవ్వలేదు కానీ కానిస్టేబుల్ తో ఫోన్ చేయించారు ఇంటికి పంపారు అతనేమో కేసు వివరాలు నాకు తెలియదు స్టేషన్ కి రమ్మని చెప్పమన్నారు మా si గారు అందుకే మీరు రావాలి అని అడుగుతున్నారు.... మా తరుపున ఒక పెద్దమనిషి si గారికి ఫోన్ చేసి కేసు ఏదయినా వుందా వీరిని మీ వద్దకి పంపించాలా అని అడిగారు దానికి సమాధానం గా అలాంటిది ఏమిలేదు వారు నా దగ్గరికి రానవసరం లేదు వారి ఫ్యామిలీ కేసు మాత్రమే వుంది అది ఇప్పటిది కాదు అని చెప్పారు. అయినా కానిస్టేబుల్ ఇంటికి రావడం జరుగుతుంది అందుకే RTI లో sho గారికి కేసు ఏదయినా వుందా లేదా అనే సమాచారం కోసం దరఖాస్తు పెట్టుకున్నాము 20 రోజుల తర్వాత RTI దరఖాస్తు కి సమాధానం గా fir పంపించారు.... ఇప్పుడు మేము స్టేషన్ కి వెళ్లాలా లేదంటే si గారు 41a నోటిస్ పంపించిన తర్వాత వెళ్లాలా, అస్సలు si గారు మళ్ళీ 41a నోటిస్ పంపించాల్సిన అవసరం ఉండలేదా దయచేసి తెలియచేయగలరు 🙏
