In this video, Florida attorney Kelly Hyman discusses what a deposition is in a lawsuit.

A deposition is a pre-trial testimony that is given under oath. The purpose of the deposition is for the opposing council to find out what you know about the case. With the help of your attorney, you can better prepare for this important statement.

I'm glad that Vic was smart enough to be as professional and honest as possible. He isnt doing any gestures that would prove him suspicious cuz he knows he's right and telling the truth. #istandwithvic

How do you know if the deposition is a court ordered subpoena? "I am serving you with a Notice in Lieu of Subpoena for your Deposition, as well as a Notice to Take Deposition." My father in law is being divorced by my MIL and he hasn't produced the majority of his documents for discovery (Not like it matters, but he left her for another woman and moved across the country). He also no showed or called his rescheduled MESP. We are assuming he will just ignore this Notice and not attend the Deposition. I'm guessing he won't be held in contempt of court because it says, " Lieu of Subpoena". I know it won't look good for him, but if it's not an official court ordered subpoena, he isn't forced to go, right? We are all just frustrated because he's done whatever he wants up until this point with no consequences so far.

I hired a lawyer but he will not talk with me and he was not prepared for the case. He didn't even know my name. I had to correct it on the stand. I have tried several times to talk with him since and I was told to "quit interfering in the case" because they have everything under control. We were supposed to have be in court today and he knew nothing about it. What can I do?

I can stay silent during the deposition? Or do I have to plead the 5th?

Kelly; Did you take a lot of ribbing about your name when you were in school?

First off, never allow anyone to swear you to an oath of any kind.. never answer any questions whatsoever at any time of any lawyer or judge or anyone who can and plan on doing harm to you or anyone you know.. she is right about one thing, these folks are NOT YOUR FRIENDS.. so why would you allow them to BIND YOU UP by allowing them to have a deposition and placing you in jeopardy? Invoke all your natural and unalienable rights and waive none.. and learn to say, I DO NOT CONSENT..
