The defense noted the defendant's willingness to enter a treatment program and requested more time for her to turn herself in, so as not to lose her jobs.

The prosecution highlighted that the jail time recommendation was based not only on missed tests but also on positive results for controlled substances. The defendant acknowledged her use of a controlled substance, stating that she had used it once with her father, who also uses the substance, in an attempt to help him seek treatment. Despite this claim, the court noted that there were two separate positive tests for controlled substances, which contradicted the defendant's assertion that she had only used it once. The defendant explained that she misunderstood the process and believed the second test was a retest of the original sample.

During the hearing, the court expressed concerns about the defendant’s continued use of controlled substances while on bond, a violation of her conditions. The court acknowledged the situation as a misdemeanor but found sufficient grounds to deviate from a non-probationary sentence, citing the defendant's need for intensive outpatient treatment and attendance at AA meetings.

She's way too old to believe this seasoned jurist has any intention of believing what she's shoveling. If he ever wore boots for all the road apples he had to listen to, he doesn't any longer. He's also sitting on a raised dais, so he'd remain unaffected either way.
