The legal principle Jordan Peterson is referring to is called "Terra Nullius" Terra Nullius was used by European colonisers to take land from Indigenous people who they considered 'primitive''. A primitive person was not considered to make "full economic use" of the land, and therefore a European coloniser had the legal right to take their land. Entire populations, cultures and languages have been wiped out because of this legal principle. If Peterson wants to use this legal principle he might as well dig up the Nazi law and use that too.

The "they did nothing to it" argument, mirrors Ayn Rand. When asked about her view on the genocide of native americans, she said that "they werent doing anything with the land." She didnt find it a tragedy, but the right of the "civilized".
