AFTERNOON UPDATE: Because the judge is likely to grant 23XI's new injunction request, NASCAR has agreed to an injunction allowing 23XI to acquire the SHR charter.

Per Bob Pockrass, this will likely speed things along to the US Court of Appeals.

I'm not surprised the "You can't sue us" clause is causing NASCAR trouble - based on that alone, I was pretty certain that 23XII and FRM had a pretty legit antitrust case. To me, the fact that was even in the charter agreement was indicative of NASCAR feeling too comfortable that the teams would just play along, and not fight NASCAR. They've gotten away with too much, for too long, arrogance has taken root, and is coming back to bite them.

I don't blame NASCAR for wanting to appeal. This is literally the last bit of leverage they have to force the teams to bend before they get to discovery. Short of being forced to open their books, they can't hurt their reputation with fans any further. Everyone's already made up their minds (for now), and they have nothing to lose by trying. But man, if they lose the appeal? I expect they'll do their level best to make this go away before discovery, because I'd be willing to bet those secret books of theirs are gonna bring to light a lot of skeletons in a lot of closets that they'd much rather stay hidden. Better to eat crow than show exactly how much money they're bringing in that the teams don't get to sniff.

The other teams signing actually helps 23XI and FRM's case. Those owners felt pressured to sign because NASCAR is the only game in town. The exact definition of a monopoly. Does NASCAR deserve to make a profit, yes. However, they have to realize that starving the teams will not result in the product being successful.

At this point, i don’t see how NASCAR could not be found liable for violating anti trust laws, I can’t imagine them winning any appeal to said injunction….. I see the teams winning and NASCAR getting a huge fine and be regulated from here on

I mean, if the 9th Circuit has been stamping down on "You must agree to arbitration and can't sue us" clauses, why would NASCAR even think that you can't sue us on Anti-trust claims is any more legal?

Seriously, this is a running theme over the last 5 years.

If Denny Hamlin manages to change NASCAR’s business model for the better, let’s all vow to never make another “Denny Hamlin got no rings” joke again. He may be cocky and whatnot, but give him credit he’s doing something about the flaws in NASCAR’s business model. And to me, that’s worth 10x more than some empty cup.

(Besides, does the championship even mean anything anymore if you can have a 17.1 avg finish and still win the title?)
