You Americans are crazy. How would pressing charges to a 10 years old be a thing ? My mind is blown. The only one that could be responsible for this is the person who is taking care for that kid. The caregiver is the one who must have his/her eyes on the kids at all times and prevent such accidents. When they accept payment they accept all ligal responsibility too. Now that I think about it, the director made a trick tring to blame the kid, and in reality he was the one that would have been sued
