he best EULAs are the ones that change with an update, an update that if you don't download, will render much of the software unusable and good luck getting your money back if you don't agree with the latest additions to the contract.

Consumer rights... only if you're rich, powerful, or influential enough to make the company squirm.

My Computer Science teacher once told me that large software companies(Apple, Microsoft) employ more legal staff (lawyers etc) than software staff.
Plus the Legal departments of said companies exploit loopholes through several laws (many lawbooks aren't up-to-date with internet stuff for example)

Apple got their taxdeals through this aswel

I always read those updates after that individual was sued for hacking his PS3.

Nintendo's update has something in it that legally allows them to brick your console if caught using outside unlicensed software.

last i heard about it EULAs were actually completely to be ignored in Germany, since the rules are only revealed to you after you paid, which makes them void.

For many FOSS projects there is no EULA but there is a license. However, assuming it is the GPL license, the only rules it enforces are:
The software publisher must make the source code available and allow other people to distribute modified copies; and anyone who is creating their own version must also license it under the GPL.

I remember a while ago a company released some sort of software, cant remember what it was. It had a EULA and there was a clause somewhere in it that if you sent them an email you get a $1000 check, which someone claimed. They put it in there just to show how many people don't read EULA's. 3000 people bought the software and agreed to the EULA before him, showing that most users don't read it.

EULAs are nonsense because they rarely have a feasible option to decline the EULA and get a full refund at the point you are reading it. Most often you open the packaging or install something to the point the EULA Pops up and many merchants will not accept a return at this point since it is an open box or used product key. Thus it is not an agreement at all but a demand after the fact.

Yeeey in the uk we actually do buy the software, and when they don't change the eula the contract becomes invalid. Also nobody under 18 can agree to any of them legally. Also in the UK there is no way for a eula to change a contract after sale. So unless you pay after agreeing, it has no basis in uk law, unless they want to request a contract renegotiation. Love being in the UK, unless they extradite me, always a risk!

But yeah, it is considered unlawful and unfair after purchase to demand terms, so they are unlawful in uk law (and to be honest are kinda illegal to include in the first place, as they are making false claims on culpability)

This is why having the internet at large pointing out glaring obscenities in EULA's is a great thing, because the people writing these things know most users don't have the time to read entire encyclopedias worth of that crap, making it one of the perfect places to hide anti-consumer shenanigans.
