The question that keeps bouncing around my head is this: Do the terms and conditions of a scam have any legal standing? If a company is found to be illegitimate, and all or most of it's customers are victims of a premeditated criminal act, do the restrictions of the terms and conditions get voided as part of the criminal act? Can a scam use legal documents to limit their liability? That seems shady as hell.

To go further...Can a legal document, drafted in good faith still apply if later on it becomes a scam?

I remember one of the guys who spent half a million is in Australia. I’d imagine he’d pursue legal action too considering how much money was involved. Logan’s legal fees are probably gonna get much worse now since his case just became incredibly more complicated for his lawyer to work on lol.

You make a point between Clickwrap, browserwrap, and signup agreements . You present the difference as what makes the Class Action possible. My problem is that while Clickwrap is presented as allowing "consideration". Except that usually accepting the Clickwrap is required to proceed. So you are presented with a choice of either accepting the new conditions or losing anything you have in the system. I would hardly call that consideration, especially here where we are talking goods presented as tradable commodities. Effectively, you have made a purchase only to have the merchant change the deal after the fact; and if you don't like it then he just keeps your stuff. He already seized your purchase, and is now holding it hostage to your compliance with the new agreement.

We sign a contract on the notice board at the office stating:
You give me a pot of cookies to take care of, and I can NOT eat the cookies.

Then the next morning I addend the contract with:
I can eat the cookies.

Then unless you're from Texas, you have no case and I can eat your cookies.
