I loathe Trump as much as the next guy, but I can't really criticize this move. In order for defamation to be proven, it must be demonstrated that:
First, the plaintiff must prove that the defendant made a false and defamatory statement concerning the plaintiff.
Second, the plaintiff must prove that the defendant made an unprivileged publication to a third party.
Third, the plaintiff must prove that the publisher acted at least negligently in publishing the communication.
Fourth, in some cases, the plaintiff must prove special damages.This is why defamation lawsuits are so tenuous.
That being said, a defamation lawsuit is the least of his worries. The real threat is whether or not her payment violated campaign finance rules, and this is not a settled matter. The ongoing narrative of Trump's awareness of this suit has increased steadily and provided numerous contradictions that should be addressed.
