The Ministry of magic doesn't give warnings for Lumos. In "Order of the Phoenix, " the book, he did both a Lumos and a Patronus when the Dementors attacked, but was only prosecuted for the Patronus. My theory is that certain low-level spells aren't detected or bothered with. Lumos is basically a flashlight spell that could be considered basic utility that muggle technology easily duplicates.
