It sounds to me more like theyre saying with a prescription you can use HSA/FSA/HRA funds for those things.

It sounds to me like they may be talking about HSA or FSA which is pre-tax dollars and as such doesn't have the 7.5% or 10% threshold.

But it is not that easy to get a doctor to write a letter claiming it is medically necessary. They could be putting themselves and their license on the line if the IRS and other medical agencies were to find they are writing these letters to everyone and anyone regardless of medical necessity.

Note, this is one of those things that if you have a true medical need and can get a doctor to give you that letter, more power to you!

Not tax advice, but if my doctor can write a prescription for it, I ask them to do it, specifically for OTC drugs. It just saves a ton of money. Those same OTC drugs you're paying $10-$50 for you can get for 50 cents to $2 by getting a prescription.

I love how the comments are more educated in this regards. However, I think these would already be covered by HSA even when not written by a script. Example: sunscreen is covered without a rx.

Guess we all should be using HSA for groceries. Yes, eating food is medically necessary.

For people wondering about FSA/HSA/HRA - no. Food, is not generally eligible for tax free disbursements under those programs. There are limited exceptions, such as when a doctor orders a patient onto a more expensive diet as part of a treatment plan. In which case, the difference in cost between the medically necessary diet and the ordinary diet is eligible for FSA/HSA/HRA Reimbursement.

I've had doctors write a prescription for over the counter drugs that I needed but it wasn't for tax reasons, it was for insurance reasons. Since I had a prescription, I could have insurance cover them/use my HSA to pay for them.

Would purchasing say $50, 000 of exercise/gym equipment count? Or no because you could just get a gym membership for cheeper, therefore a Bowflex is not medically necessary??

Yes they’re talking about HSA/FSA dollars (pretax). They’re also talking about using it for food and gym expenses. With a doctor’s note, you could see how it should be deemed medically necessary. Or how about getting rid of income tax altogether? 🙃

sounds like HSA - tax advantaged dollars. Ever had to use a physical therapist for months on end ? Really useful to know the amount above the threshold otherwise as well.

I have heard gluten free products were deductable for my husband's Celiac but it is hard to keep records since I buy them along with the rest of our groceries and receipt doesn't always list gluten free. They are medically necessary and more expensive than regular food but I doubt we spend more than 10%.

Quick q.. $3500 car repair used for business. $500 out of pocket expense the rest covered by iinsurance. Is the entire repair cost deductible or just the out of pocket

I’m a CPA as well and I assume they were referring to using HSA/FSA funds for this not on the personal tax return. I suffered from a major accident and part of my therapy included some regular physical therapy, since I couldn’t do more physical therapy in office my doctor prescribed me the instruments i needed at home to continue my care my FSA plan paid for everything needed. Stationary bike, bands and some weights.

They're talking about using HSA money, not itemizing :(

If you live in New Mexico you can deduct medical expenses without itemizing

Similar question to others. What about HSA/FSA dollars?

BenGoldwater

So, would this apply for cancer treatment which can be extremely expensive? Obviously it’s necessary.

It helps get over that 10%.
You also missed it can be paid with HSA

Would doing what you said be beneficial to someone in the sub 100k category with an obscene amount of medical debt?
