The answer, legally speaking under the auspices Graham vs Conor, is MAYBE. the US Supreme Court ruled under case this case law that they have to review the situation based on “AS THE PERSON SEES IT AT THE TIME OF THE COMMISSION OF THE ASSAULT”. What this means legally is that the court absolutely must review each situation as if they were viewing through the eyes of the person defending their life. If someone had their throat being joked or were being beaten to death then they could potentially use deadly force against another person’s hands and/or feet. That is the correct legal analysis of using deadly force against the lethality of hands and feet only where no other weapons are involved.

Great information as always.
I use a cane, unless I'm walking my dogs, then I have a hiking stick. With a bad back and not able to move very fast, I would use what's in my hands until it is safe to bring my gun out. I hope I never have to shoot someone, but if it's them or me and my family, I'm pulling the trigger and not stopping until I know they are no longer a threat. That's what the Sheriff that gave our CC class in Iowa said to do. He also said that if you have any doubt about shooting someone that is trying to hurt you, you have no reason to carry a gun. If they take the gun from you and kill you and others with the same gun, you are responsible for every death with that gun.

As Mass Ayoob once stated in one of his training seminars, you can always ask your assailant if they are a black belt before they begin their physical assault. If they say yes then you know that they have advanced martial arts training.

This is very true. An old Green Beret colleague of mine was involved in a bar fight in with 3 guys. He did not start the fight, but he finished it. To make matters worse, one of his assailants was the son of the town sheriff, who had him arrested and charged with a deadly weapon. It took him almost two years in court and a lot of money to get his name cleared.

Yes, I am trained, and I continue my training while I train others in self-defense. General rule we teach everyone since the adrenaline is up, simply respond to the police, "I was in fear for my life, I would like to be taken to the hospital".
This serves multiple purposes.
It's a traumatic experience so your head is not clear and the adrenaline is dropping, and honestly you may never be clear enough to explain details, but you'll have some time away from the police and time to gather your thoughts, calm down, and contact an attorney, very necessary.

Love y'alls content and that y'all are from Texas as I am a fellow Texan. My main question is why some prosecutors are so zealous to prosecute regular citizens who maybe made a bad decision while being placed in a situation by a career criminal with a rap sheet with more arrest for violent acts than the number of years they are alive. The citizen who probably doesn't spend time thinking about being in a dangerous situation is suddenly forced into a situation and having a rush of adrenaline fight or flight and they kill the criminal while in this state and the prosecutor want to send you away for life while the criminals constantly get out to seek out more victims.

One other thing I could not claim any of what I wrote below as I have been in the U.S Army and a Correctional Officer for the State of Texas so I know how to keep control during times of high stress and dealing with adrenaline rush, tunnel vision, and how things seem to move in slow motion but I know most people are not trained for dealing with such instances and even professionals such as police officers will get tunnel vision or swear they only pulled the trigger once when in fact they emptied the entire magazine. Why is it the criminal who put the average citizen in this situation doesn't bear the blame for their own demise.

If carrying a weapon concealed or off duty, don't get lulled into a false sense of security or even invincibility.
There are some unarmed people who will incapacitate you before you can break leather.
Consider avoiding doing stupid things, with stupid people, in stupid places.

Guys I am a martial artist and an instructor in 3 different martial arts. This is great advice. One question as I had a discussion with a former co-worker a while back. He claims that in Texas if you are a black belt in a martial arts you have to inform a person who is threatening you about your status. I argued that his assertion was based on an old law and doesn't apply today as you have 13 year olds who are "black belts" and they wouldn't stand a chance against an adult. I also believe in the element of surprise, meaning an attacker already has it in their mind how they are going to attack someone and by not announcing your Black Belt status it gives you an edge in defending yourself

People have been known to die or suffer irreparable harm from being hit with just a fist— in say the temple or simply punched and the person falls and hits their head on a hard surface. To me, empty hands, regardless of training, can lead to lethality and as such a person shouldn’t be judged based on what the aggressor used as a weapon but simply based on the fact that no one should have to rationalize the use of lethal force in the moment of being attacked by another. No one should have to get into hand to hand combat simply because their attacker doesn’t wield a “weapon”.

Love this channel. All martial arts training military and otherwise is for self defense not for going out to kill people. If you use martial arts in an should be to protect yourself and others. Also take into account size age numbers and presence of weapons. People who ask the old hands as deadly weapons question watch way too many movies.

I always thought the reasoning behind Cage's character being locked away in the movie was fanciful and much too contrived. Still a fun movie, though. It's actually what came to mind when I saw the thumbnail for this video :)
