An easy question to answer. Read the Constitution and the Bill of Rights, then ask yourself which party more closely upholds those ideals. It's not a perfect system but it's the best out there.

The fact that John McCain wanted to appoint judges who strictly adhered to the Constitution is why he *should've* won the 2008 election; just look at what appointing people who *disregard* the Constitution has done to the *people* for proof of that.

The question was asked, "Should the supreme court make decisions based on what is written in the constitution and legal precedent....? Yes and no. Yes, decisions should be based on what is written in the constitution. No, decisions should not be based on legal precedent. Legal precedent = permanent mistakes. Precedent and stare decisis are the stuff of fools.
