Grounds for Rejection of Writ Petitions| Res Judicata| Article 32| Article 226|

Do all Writ Petitions get accepted in the court of Law ? No, there are certain grounds on which writs could be rejected. This video explains about some of those grounds.

Res Judicata Does not apply to Habeas Corpus

Essential Ingredients of Res Judicata:
1. Suit must be maintainable and of Civil Nature.
2. There must be 2 suits, prior and subsequent suit .
3. Parties must be same or litigating under the same title.
4. Matter must be decided by a competant court of jurisdiction.
5. Matter must be directly and substantially in issue.
6. Matter should have been heard and finally decided in the former suit.

आदरणीय सर/मैडम,

आप एक मामले में उच्च न्यायालय में रिट दायर करते हैं(व्यक्तिगत रूप से याचिका-Petetion in Person) और आपको एक (केस डेयरी नंबर- Case Dairy Number) मिलता है!!

उसके बाद आपको उच्च न्यायालय से रिट में आपत्ति ( Objection) प्राप्त होती है

उसके बाद आप उच्च न्यायालय से रिट फाइल वापस लेते है - और जांच करते हैं की कहा पर ( objection) आपत्ति प्राप्त हुई!

उसके बाद त्रुटि को सुधार कर क्या करना चाहिए?

(i) आप रिट याचिका फिर से दाखिल कर सकते हैं, उसी मामले में डेयरी नंबर जो आपको पहले आवंटित किया गया था!

यदि हाँ तो कैसे कर सकते हैं?

Please guide me that I have submitted written Statement in Second Appeal in CIC

Respondent also submitted their Written Submissions to CIC

But Respondent has not denied my Written Submissions in writing or Orally in CIC

Can I use them as amount to admission in my Other Write Petition in High court stating in Write that same Respondent has not denied my Written Submissions in CIC which amounts to admission

Hello mam please guide me, i totally belong to a economically weaker section in the general category and my revenue officer and other authorities are denying me of such EWS certificate by saying that i don't possess land, mam you tell me if i had land and property then how come i eligible for reservation... Ma'am I need some help in filing reply to a notice received from Delhi HC. UPSC has filed a Writ challenging the orde of CAT which is in my favour ordering the UPSC to remake the merit list following the rules and supreme court guidelines. I am fighting my case on my own a party in person. Can you please help me?
