Habeas Corpus is not just for those in "jails". Read the definition. I filed a Habeas Corpus with the 254th District Court in Dallas was denied because the CSEA officer had never heard of this situation before so the "judge" denied it. I subsequently filed a Demand to Vacate Ab Initio. In both cases the respondents, my ex and the CSEA did not respond, but "judge" Ewing had me removed from the Court room and stating I could no longer file documents in the case without the Courts permission. She did not rule on my Demand. I appealed it to the 5th Circuit of Appeals. I responded to their letter of Jurisdiction issue and that has been 3 weeks ago; the CSEA office did not respond to that either. So my next step is to file a Habeas Corpus with the Texas Supreme Court. Then I will file a Federal lawsuit against Dallas County and the CSEA office-Dallas.

My brother is going to court habeas next month, challenging the indictment, asserting lack of subject matter jurisdiction.. But he is unsure how to present the claim! In been in Prison for the past 12yrs for an accidental homicide.. which he believes that he was never indicted by a Grand jury..- he saying that due process of law says: no person shall be held to answer for a capital or infamous crime except by presentment or Grand jury indictment....- he don't believe a Grand jury indicted him.. for he requested for the precept summons recit, and the minutes where each jury answer to their names and signified there presence.. but the clerk of court say that they don't have those records in their office..

Any advice would be great.
