We've had that in Illinois since 1998, called a Voluntary Acknowledgement of Paternity. Works as a court order. But still had to open a case to set parenting time/support.

What happens if the father does not show up or is not involved in the child’s life. There is a time sharing and paternity in place but he never helps and the minor is now 4. How can a mother get sole custody

My question is, is the new law retroactive? For example, i am on the birth certificate and their mother and i filed the acknowledgement of paternity at the hospital. Under this new law do i have equal rights? Or do i still have to jump through all the hoops we had to before? I have a current problem.
Child lives with grandparent as of current.
Mom in jail.
I as father have a DNA establishing me as child father.
DCF in now involved with grandparent.
DCF found out grandparent has no custody or rights to child.
As of now we don't know if I can just go get child with out getting into legal trouble.
No one is trying to help me.
