The overtaking vessel is the one at fault. When being overtaken you are the stand on no matter the pecking order. However you can always take action to avoid collision but I’m not sure if she could have taken evasive action. That seems deliberate imo to hit your competitions boat.

For everyone bashing her her job is to maintain course if he wants to overtake her he has to adjust she did the right thing

Col.Regs state that she has the right of way and he must stay clear until he has overtaken.
She is allowed to change course to avoid an incident or lessen the impact of one.
She appears to have behaved and acted impeccably.
He should be sued for repairs, along with whatever collateral financial damages have been incurred, as well as punitive damages.
There are also questions as to whether he is a fit person to be in charge of a vessel, but that is a matter for a Court of Inquiry to decide.
