According to the Congressional Research Service “Section 3 of the Fourteenth Amendment does not expressly require a criminal conviction, and historically, one was not necessary. Reconstruction Era federal prosecutors brought civil actions in court to oust officials linked to the Confederacy, and Congress in some cases took action to refuse to seat Members.” Furthermore, Federalist Society legal scholars William Baude and Michael Stokes Paulsen wrote in a law review paper that Section 3 is "self-executing, operating as an immediate disqualification from office, without the need for additional action by Congress". The people are therefore perfectly entitled to bring a case to court for Trump to be banned from the electoral ballot on this basis. Th court was then presented with evidence of insurrection and found Trump to have engaged in insurrection and therefore ineligible to hold office.
