The Espionage Act hosts a whole series of provisions. One of which is 792E. Unlawful retention of classified information. Sorry, Lyndsey.

The case is already in peril because of an incompetent biased judge, no chance of appealing, and possibility of lenient sentencing

I wonder if it wouldn't be easier to have the judge and all the members of the jury pool only be people with TS/SCI clearance; that way they could view the evidence and not be afraid of the consequences. Perhaps replace aileen with Judge Raymond Dearie (I think he has such clearance?). Just spitballing here, of course.

The fact that two thirds of the documents are too sensitive to be brought forth in a court of law tells us a lot about how juicy the Trump Presidential Library for Covert Foreign Nationals really was.

The •entire• point of the prosecution is that these documents are not to be seen by anyone without security clearance. The designations upon the documents preclude them from disclosure while disclosing their status us classified. Period.

This is why nations that currently are sharing intel with the USA have to really think twice about what intel to share because Trump or one of his political enablers that get back into power may do this again.
