Cases that can be tried summarily
Offenses that are not punishable by death, life imprisonment, or a sentence of more than two years in jail. If the value of the stolen property is less than 2000 rupees, the theft is punishable under Sections 379, 380, or 381 of the Indian Penal Code, 1860
Summary trials can be held only by a District Magistrate or a Magistrate of the first class empowered in that behalf, or a Bench of Magistrates empowered under either section 260 or section 261 of the Code. Only offences specified in these sections may be tried by this procedure.
264 of the code of Criminal Procedure, 1973 Judgement in cases tried summarily. In every case tried summarily in which the accused does not plead guilty, the Magistrate shall record the substance of the evidence and a judgment containing a brief statement of the reasons for the finding.
