In Thwaha Fasal vs Union of India, the Court has acted in its introspective jurisdiction and deconstructed the provisions of the Unlawful Activities (Prevention) Act (UAPA) with a great sense of legal realism. This paves the way for a formidable judicial authority against blatant misuse of this draconian law.

In this video we will discuss
1. UAPA - Issues
2. Judicial Interpretations of Provisions
3. Concept of Presumption of Guilty
4. Thwaha Fasal Case

I'm from Assam and one of my client is arrested on April 2021 in connection with a 2007 case and now it's November 2021 and he is constantly denied of getting bail although charge sheet is already filed court rejects bail recordings a single reason that there is sufficient material against the accused although in the FIR or in CS there is nothing serious in nature he is booked under section 10& 13 of UAPA act and accused family members are too poor they can't move before High Court.
